What Can Grandparents Do When Their Grandkids Are in State Custody?
Oklahoma law establishes an order of preference that the state should follow when they're making those placement decisions and grandparents are right below parents under Title 43. So the first step here is to try to get placement of the grandchild with the grandparents as a foster option. Grandparents have a tremendous influence on the values and behaviors of their grandchildren. A recent study out of Cornell University showed that nine out of 10 adult grandchildren stated that their grandparents had a major impact on their values and behaviors as adults. Now, this is pretty intuitive to understand. I think all of us who were fortunate enough to have grandparents in our lives as children remember lessons that we learned from those grandparents, interactions we had with the grandparents that were really different from the time that we spent with our parents. The Oklahoma Constitution grants sole authority to make decisions about who the child associates with to the parents. According to Oklahoma Attorney Justin Mosteller, under Oklahoma law, a grandparent can file to establish visitation rights if they meet a few requirements. First and foremost, the nuclear family has to be disrupted. Now, that means that mom and dad have gotten a divorce, one of the parents has died or the child was born out of wedlock, or maybe the rights were terminated to one or both of the parents.
