And I’m here to discuss this topic with you a little bit today. Unfortunately, grandparents do not have a right by default to get visitation with their grandchildren. The State of Oklahoma and the constitution have vested the power of deciding who should associate with the child, exclusively in the parents, absent a grandparent rights visitation order.
In Oklahoma to establish grandparent visitation. You have to show that the nuclear family has been disrupted and that a parent is either unfit or there is a pre-existing relationship between the grandparent and grandchild, such that it would be in the best interest of the grandchild for that relationship to continue.
That’s where a lawyer comes in, really, if you are being denied visitation with your grandchild, and there’s nothing you can do about it until you establish those grandparent visitation rights.
So you should seek an attorney and file your case, and you really should do it as quickly as possible because the longer there has been a gap in the relationship between the grandparent and the grandchild, the less likely the court would be to actually order grandparent visitation.
Because it does have to be in the child’s best interest and that requires that the grandchild has a preexisting relationship with the grandparents and it’s in the best interest of the child for that relationship to continue.
